This is the Terms of Service document (hereinafter collectively referred to as "the Terms") governing the website visitors and member's (hereinafter collectively referred to as "the Users") usage and access to the Traworld website and mobile application (hereinafter referred to as "the Platform" contained herein on this webpage, shall govern your use of this website, including all pages within this website (collectively referred to herein below as this "Website).
These Terms apply in full force and effect to your use of this Platform, and by using this Platform, you expressly accept all terms and conditions contained herein in full.
You must not use the Platform if you have any objection to any of the available terms and conditions.
This Platform is not for use by any minors (defined as those who are not at least 18 years of age), and you must not use this Website if you are a minor.
Traworld and its affiliate partners (hereinafter referred to as "us", "We", "Traworld") provide an online platform through which our partners and/or service and trip providers (hereinafter to be referred to as "Merchants") - may in their professional conduct of business (i.e. B2C or B2B) - advertise, market, sell, promote, and/or offer (as applicable) their products and services for the order, purchase, reservation, rent, or hire, and through which relevant members and visitors (hereinafter referred to collectively as "Users") of the Platform can discover, search, compare, and make an order, reservation, purchase, or payment (to be referred to collectively as the "Service").
By using or utilising the Service (e.g. by making a reservation through the Platform), you agree to enter into a direct (legally binding) contractual relationship with Traworld where you make a reservation or purchase a product or service (as applicable).
From the point at which you make your reservation, we act solely as an intermediary between you and the Merchant(s), transmitting the relevant details of your reservation to the relevant Merchant(s). Apart from maintaining the website and facilitating the payment service, we are also responsible for sending you a confirmation email for and on behalf of the Merchant. We are committed to safeguarding your Personal Information as outlined in Clause 5 in relation to our Privacy Policy and we do not (re)sell, rent out, or offer any (travel) product or service as such.
In the course of facilitating the Service, the information that we disclose is based on the information provided to us by the Merchant(s). As such, the Merchant(s) that market and promote their Service on the Platform are given access to our systems and Extranet through which they are fully responsible for updating all information that gets displayed on our Platform as enshrined in clause 4 herein.
Although we will use reasonable skill and care in delivering our Service, we will not verify and cannot guarantee that all information is accurate, complete, or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade, or maintenance of our Platform or otherwise), inaccurate, misleading, or untrue information, or non-delivery of information.
Our Platform does not constitue and should not be regarded as a recommendation or endorsement of the quality, service level, qualification, (star) rating, or type of accommodation of any Merchant (or its facilities, venue, vehicles, main or supplemental products or services) have made available unless explicitly indicated or set out otherwise.
Our Platform explicitly does not solicit or take part in the persuasion of Users to view or purchase any Service provided by Merchants.
Our Service is made available for personal and non-commercial use only.
Therefore, you are not allowed to resell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download, or reproduce any content or information, software, reservations, tickets, products, or services available on our Platform for any commercial or competitive activity or purpose.
Traworld allows merchants to post products and/or services.
Traworld has taken the industry recommended steps to ensure (to a limited extent) the viability of each Merchant who signs up via our KYC (Know-Your-Customer) process as outlined in clause 5.2. herein.
Each Merchant is and always shall be responsible at all times for the accuracy and completeness of the information displayed on our Platform. They will be required to set up the product's and/or service's basic details, including but not limited to the following:
Product Type;
Product Name;
Product Code;
Duration of Availability;
Number of Participants;
Product Overview/Description;
Product Inclusions;
Product Exclusions;
Product Highlights/Selling Points;
Photos & Videos;
Terms & Conditions of the Product.
Merchants are also required to set up their product's and/or service's rates, availability based on date and time as well as other general settings, including but not limited to the following:
Type of Participants;
Age Range of Each Type of Participants;
Product Date Availability;
Product Time Availability;
Booking Confirmation;
Payment Option(s);
Booking Cut-Off Time.
Merchants will then proceed to collect several key details about the Users who sign up for their products/services via their booking form. For more details on the information we collect, please refer to clause 1 in our Privacy Policy.
Merchant Details
Users (visitors or otherwise) shall be able to register as a Merchant.
Registration as a Merchant is free for the first 1,000 successful signups.
Merchant KYC Application Process
All Merchants are required to submit their Know-Your-Customer (KYC) documents to Traworld.
The breakdown of the required KYC documents and information varies according to the type of Merchant as outlined below:
Tour Operators
Due to the wide range of products and/or services that are available for tour operators, the submitted KYC documents may take longer to process as a result of our intricate document verification and checklist process.
All KYC documents will take approximately seven (7) working days to be processed.

Tour Guides
Due to the large number of uncertified tour guides that provide such services, we perform an in-depth, intricate KYC document verification process to verify and authenticate tour guides who join the Platform.

Attraction Merchants
Attraction Merchants are merchants or partners that offer existing entrance ticket promotions and packages to amusement parks, museums, and other attractions such as but not limited to Universal Studios, Seaworld, London Dungeon and Aquarium, etc.
All KYC applications will take approximately 2 to 3 working days to be processed.

Experience Host
'Experience' in this context refers to any and all activities that go beyond the typical tour or class.
Instead, these tours are designed and led by locals/hosts around the world.
This way, locals/hosts get to share their experiences, stories, culture and culinary delights with their clients for a more personalised tour.
All KYC applications will take approximately seven (7) working days to be processed.

Other Merchant KYC Applications
All Merchants that do not fall under the Tour Operator, Tour Guide, Attraction Merchant, and Experience Host categories (as per clause 5.2.2.1 to clause 5.2.2.4) will be required to tailor the details of their selected KYC document to follow the requirements set for the Attractions Merchant (clause 5.2.2.3).

On this Platform, the Content refers to the following but are not limited to:
Any audio, video, text, images or other material you choose to display on the website or mobile application.
All of the intellectual property rights on the Platform shall be owned by Traworld.
We have no particular special relationship with or fiduciary duty to you for accessing and using this Platform and the Service as well as their corresponding content.
You acknowledge that we have no control over, and no duty to take any action in situations with respect to:
Which users gain access to this Website;
What content you access via this Website;
What kind of effect any of the advertised content may have on you;
How you may interpret or use the advertised content; and
What actions you may take as a result of having been exposed to the content.

Your interactions with organisations and/or individuals found on or through the Service including but not limited to the Merchants, payment and delivery of products or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organisations and/or individuals.
Users are recommended to conduct whatever investigation that is deemed necessary or appropriate before proceeding with any online or offline transaction with any of these third parties.
You agree that we shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between participants on this site, or between users and any third party, you understand and agree that we are under no obligation to become involved.
In the event that you have a dispute with one or more other users or third parties, you hereby release Traworld, its holding companies, subsidiaries, officers, directors, employees, agents, and successors in rights from claims, demands, and damages (actual and consequential) of every kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes.
You are expressly and emphatically restricted from all of the following:
publishing any of the Platform’s copyrighted and trademarked materials, in any shape or form, via any media without our prior written consent;
selling, sublicensing and/or otherwise commercialising any of the Platform’s materials;
publicly performing and/or showing any of the Platform’s materials;

Traworld is permitted to revise these Terms at any time as it sees fit, and by using this Platform, you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing the use of this website and its corresponding mobile application.
Traworld shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required.
However, you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms, regardless of your usage status (visitor or registered member).
These Terms, including any legal notices and disclaimers contained on this Website, constitute the entire agreement between Traworld and you concerning your use of this Website and supersede all prior agreements and understandings with respect to the same.
These Terms will be governed by and construed in accordance with the laws of Malaysia, and you agree to submit to the exclusive jurisdiction of the Courts of Malaysia for the resolution of any disputes arising from these Terms of Service.
